ORDINANCE 1051

 

PARKING ENFORCEMENT AND PENALTIES=

 

 

 

THE CITY COUNCIL OF THE CITY OF LAKE MILLS, JEFFERSON COUNTY, WISCONSIN, DOES ORDAIN AS FOLLOWS:

 

 

 

        =           Section 1.  Section 6-3-8 of the L= ake Mills Municipal Code is amended as follows: 

 

6-3-8: =             &nb= sp; REMOVAL OF ILLEGALLY PARKED VEHICLE:<= span style=3D'mso-spacerun:yes'>  Whenever any traffic officer shall find a                &= nbsp;   vehicle standing upon a street or in a parking lot in violation of the provisions of this Title, he may move such vehicle or required the operator in charge the= reof to move such vehicle to a position permitted under this Title.  If such moving is done by the Poli= ce Department or by a garage at the request of the Police Department, the cost= of such towing shall be charged to such owner or operator before he can recover possession of such vehicle.  A= ny vehicle which has been left parked in a Municipal parking lot in excess of seventy-two (72) hours shall be conclusively presumed to be abandoned and m= ay be removed to a public storage lot and in such case the owner shall pay the storage fees on said vehicle before he may recover the possession thereof.  

 <= /span>

A.        The Lake Mi= lls Police Department is authorized to take any action authorized by Wis. Stats. §§ 349.13(3), 349.13(3m), 342.40(3), and 341.65(2), in addition to exercising any other lawful authority or duties with respect to= the removal of vehicles from highways and public and private property within the City of Lake Mills.  For the purposes of this section, “tow” and “towing” means = to move or remove a vehicle to a place where parking is permitted or to either= a private or public parking or storage premises or direct or contract for the same.

 

B.  =       Pursuant to its authority under Wis. Stats. §§ 349.13(3), 349.13= (3m), 342.40(3), and 341.65(2), The City of Lake Mills hereby establishes a towing charge penalty.<= span style=3D'mso-spacerun:yes'>  Whenever a vehicle is lawfully tow= ed by or at the direction of the police department, the owner or operator of the towed vehicle shall forfeit $25.00, and this penalty, which may increase af= ter 48 hours to an amount not to exceed $35.00 if not paid, shall be in additio= n to any other charges which may lawfully be charged to the owner or operator of= the vehicle for the cost of removal, impounding, storage or disposal of said vehicle.       <= /b>

 

        =           Section 2.  Section 6-3-9 of the L= ake Mills Municipal Code is amended as follows: 

 

6-3-9: =             &nb= sp; PENALTY:  Any person who shall violate or permit anyone to violate the parking provisions of this Chapter shall, upon conviction,= forfeit not less than one dollar ($1.00) no= r more than = twenty-five dollars ($25= .00), or a late fee that can increase the original penalty to a maximum of $35.00 if not paid within 48 hours, an= d in default of payment of such forfeiture penalty, shall be issued a uniform traffic citation under Wis. Stats. § 346.56, and or may be subject to registration suspension until the forfeiture or any applicable late fee is paid. 

 

      =       Section 3.  Section 7-7-5-F of the= Lake Mills Municipal Code is amended as follows: 

 

F. &nbs= p;       Penalty:  All parking violations and all unauthorized parking may be subject to a penalty of            up t= o $25= 35.00 under section 6-3-9, or towing at the owner’s expense, or both.  Violations of paragraph C, driving in parks, may be subject to a municipal citation wi= th a forfeiture in an amount not to exceed $100 (one hundred dollars), plus costs, per violation. 

 

Section 4.  This ordinance was sponsored by Co= uncil Representative Ed Grunden.

 

Section 5.  All ordinances or parts of ordinan= ces inconsistent with or contravening the provisions of this ordinance are here= by repealed.

 

   &nbs= p;        Section 6.  This ordinance shall b= e in full force and effect from and after its passage and publication as provide= d by law.
